NPM may collect any of the following information about you if you are a current or prospective vendor, purchaser, tenant or landlord of a property serviced by NPM activities:

– driver’s license, passport or other form of identification;
– property ownership and/or occupancy details including details of properties sold, purchased, owned or leased;
– any additional information relating to you that you provide to us directly through our business activities, client surveys, NPM website or indirectly through use of our websites or online presence (including social media);
– employment details such as your employment status, employer, salary, length of employment;
– other sources of income; and
– personal and financial referees whom we may contact about a tenancy application.

We may also collect some information that is not Personal Information because it does not identify you or anyone else. For example, we may collect anonymous answers to surveys or aggregated information about how users use our website.

How do we collect your Personal Information?
Personal Information may be collected as a result of any of the following:
– when you make a general or specific telephone enquiry;
– when you engage us or discuss engaging us to provide services or advice to you;

– the National Tenancy Database (NTD) operated through Veda Advantage Information Services and Solutions Limited (Veda);

NPM collects your Personal Information directly from you unless it is unreasonable or impracticable to do so. When collecting Personal Information from you, we may collect in various ways including the above or other medium or action.

How does NPM use your Personal Information?
Any Personal Information that we collect will be used by NPM to enable us to provide you with the services that you have requested, or otherwise to enable us to carry out our functions as professional real estate agents and for the following purposes:

– providing quality assurance for our services and internal business practices;
– responding to your enquiries in relation to our business, products and real estate services;
– monitoring the performance of our business;

Can I remain Anonymous?
You can browse our website without providing any personal information, and you can access our real-estate advertising in various publications. However the majority of functions undertaken by NPM do require your Personal Information to be disclosed to us in order for NPM to provide the services sought by you.

What happens if NPM is not able/permitted to collect your Personal Information?
If you do not provide us with the Personal Information described above, some or all of the following may result:
– we may not be able to provide the requested products or services to you, either to the same standard or at all;
– we may not be able to provide you with information about products and services that you may want; or

To whom do we disclose Personal Information?

– to property inspection consultants, property valuers, business valuers, to owners corporations, to government and statutory bodies, financial institutions or financial products and services providers required to service your requirements;
– to the vendor of a property where you are a purchaser or a prospective purchaser;
– to other real estate agents or other third parties if required by a landlord or a landlord’s financier or legal representative, for the purpose of appraising or valuing a property;
– to potential tenants, to trades people and to other persons to whom we outsource functions of or incidental to acting for a landlord;
– to the general public when advertising or marketing your rental property (or your home if you are our tenant) including internet advertising or marketing, for the purposes of re-leasing or selling the property;
– to the landlord, referees, the relevant Bond Authority, other agents and third party operators of tenancy reference databases including where a tenant has failed to comply with any contractual obligations specified in the relevant tenancy agreement and to other sources necessary to identify and evaluate a potential tenant;
– to lending institutions, financiers, creditors, prospective franchisees and suppliers as permitted by the franchise agreement;
– to third party consultants who may from time to time manage our database or computer system;
– of or incidental to a sale of all or part of our business to a third party;
– as required by law, including where requested by police; and
– any other disclosure of or incidental to our carrying out our functions as professional real estate agents.

If NPM wishes to use or disclose any of your personal information in any other ways than described above, NPM will not do so unless it:
– has your express consent to do so;
– has reasonable grounds to believe that the use or disclosure is necessary to prevent a threat to life or health; or
– has reasonable grounds to believe that the use or disclosure is required by law or to enforce the law.

Direct Marketing Materials
You acknowledge we may add some of your Personal Information to our databases and send you direct marketing communications and information about our products and services that we consider may be of interest to you. These communications may be sent in various forms, including mail, SMS, fax and email. At any time you may opt-out of receiving marketing communications from us by contacting us or by using opt-out facilities provided in the marketing communications and we will then ensure that your name is removed from our mailing list.

How can you access and amend your Personal Information?
You may request access to any personal information we hold about you at any time by contacting us. Where we hold information that you are entitled to access, we will try to provide you with suitable means of accessing it (for example, by mailing or emailing it to you). NPM may charge you a reasonable fee to cover its administrative and other reasonable costs in providing the information to you. NPM will not charge for simply making the request and will not charge for making any corrections to your personal information.

To obtain access to your personal information you will be required to provide proof of identity to ensure that personal information is provided only to the correct individuals and that the privacy of others is protected, and be reasonably specific about the information you require.
If you believe that personal information we hold about you is incorrect, incomplete or inaccurate, then you may request us to amend it. We will consider if the information requires amendment. If we do not agree that there are grounds for amendment then we will add a note to the personal information stating that you disagree with it.
NPM will endeavour to respond to your request to access or correct your personal information within a reasonable timeframe. If for any reason NPM refuses your request to access or correct your personal information, we will provide you with written reasons for the refusal and details of complaint mechanisms.
